Can AI Replace A Lawyer? The Risks Of Using AI For Legal Advice
Artificial Intelligence, more commonly known as AI, is a revolutionary technology that is changing the way humans perform ordinary tasks. From writing documents to driving cars, there’s hardly anything these machines can’t do.
AI is even changing the world of legal services. Because it can analyze large amounts of data and quickly produce text, AI can be used for creating living wills, searching for laws by state, drafting contracts, and much more. So naturally, those in need of legal advice may wonder: will AI eventually replace the need for lawyers?
Read on to learn more about the use of AI in matters of law, and whether AI legal advice can replace a human lawyer.
Laws Are Often Not Black Or White
In some aspects of law practice, such as business law, not much is ambiguous. But oftentimes, laws exist to provide a framework rather than a specific blueprint. There can be many exceptions or loopholes in certain situations that AI is not intelligent enough to recognize. True, AI is “intelligent” in that it can replicate and produce data in a short time frame. But recognizing gray areas requires a different sort of intelligence: a uniquely human kind.
When it comes to interpreting laws, experience and understanding play a huge role in understanding the bigger picture. AI can generate blanket answers that may be outdated, incorrect, or not apply to every company or circumstance: only a human mind can do that.

Legal Matters Require Expertise, Nuance, And Insight
It takes a lot of work to become a lawyer, and even more work to become a successful lawyer. If it were merely about retaining and regurgitating information, then almost anyone could do it. But being a good lawyer involves savvy decision-making, understanding nuances in the law, the art of persuasion, and much more. Such aspects of practicing law are so distinctly human that a machine can never imitate them.
Other things that lawyers do, and AI cannot, include:
- Recommending when certain terms of a contract should be flexible, and which ones should be fixed;
- When it’s better to accept a settlement, make a plea deal, or go to court;
- Whether new legislation will affect a client’s business, or whether it can harmonize with existing operations.
AI is also not capable of recognizing context. A solution to one problem may be the worst conclusion to another, depending on the client and the circumstance. AI cannot understand business objectives or the importance of professional relationships when making decisions. It also cannot assess options that are best for clients in terms of finances, relationships, or overall business success.
Assessing risks and calculating which decision will have the least amount of impact is a very human problem that requires a human mind to solve.
Attorney-Client Privilege Is Not Protected
“Attorney-client privilege” refers to private communication between a lawyer and the client that cannot be used against that client. It’s important to note that such privilege does not yet exist between human and machine. Considering how common it is to enter personal data into AI generators, it’s imperative that people understand this.
Are There Aspects Of Legal Work Can AI Replace?
AI works the strongest when it can sort, compare, or generate information. However, AI is a poor replacement for face-to-face communication with clients. It cannot understand nuance, which is incredibly important when applying existing laws to real human lives and circumstances. It also cannot understand conflicting facts or use persuasion convincingly. In short, as a machine, AI cannot effectively replicate the aspects of a human mind that are uniquely, well, human.
AI tools can do many things faster such as research, comparing documents, editing, summarization, and more. When used well, it can cut down on paperwork and theoretically, this can allow lawyers to devote more of their time to strategies, negotiations, and communication with clients.
However, as a tool developed by humans, AI is subject to human error. It should not be trusted blindly without being checked by real human eyes and compared to human expertise.
